Terms and Conditions
This website is owned by Adventurous by Nature Pty Ltd as trustee for the Hile Family Trust trading as Adventurous Women (ABN 96 475 116 939), herein after referred to as "Adventurous Women", unless otherwise specified. Use of this website is subject to the following Terms & Conditions and applies to any booking made through the website or through direct contact with Adventurous Women. In these booking terms and conditions, "you" and "your" means all persons named on the booking (including anyone who is added or substituted at a later date). "We", "us" and "our" means Adventurous Women. "Service Provider/s" means Third Party.
1. Travel Related Adventures - Adventurous Women is not a licensed travel agent (Travel Agents Act 1985), nor a carrier or hotelier, nor do we own aircraft, hotels or coaches. The services Adventurous Women provide consists of arranging and coordinating accommodation, tours and transfers, escorting tours, and introducing clients to various third party travel service providers. We exercise every care in the selection of reputable travel agents, airlines, tour operators, coach operators, hotels and other service providers of the various travel services which are used in these tours. It is important to note, therefore, all bookings with Adventurous Women are subject to the terms, conditions and limitations of liability imposed by the service providers whose services we utilise, some of which limit or exclude liability in respect of death, personal injury, delay and loss of damage of baggage. Because of this Adventurous Women does not accept liability for events beyond our control, nor liability for accidents incurred due to actions taken at your own risk.
Each of our Tour Operators have their own booking conditions which will be available for you to read prior to payment of your deposit for your chosen Itinerary. Please ensure you read them carefully, as by paying your deposit, you acknowledge that you accept these booking conditions.
2. Adventures other than Travel - Adventurous Women acts as an agent only. Adventurous Women acts as an agent for third party service providers for the purposes of marketing their service or adventure. When you undertake an adventure your contract is between you and the service provider and you will be subject to the Terms and Conditions of that service provider. Adventurous Women will provide these Terms & Conditions prior to accepting any payment from you. Please ensure you read them carefully, as by making a payment, you acknowlege that you accept these booking conditions. Adventurous Women make no guarantees or warranties implied or otherwise about the services that are provided to yourself by our service providers.
3. Adventurous Women has no liability for any damage or loss caused by any negligent omission or act of any service provider or third party. Adventurous Women has no liability for any act, default or omission, whether negligent or otherwise, of any service provider. Where Adventurous Women's liability cannot be excluded, such liability is limited to the value of the adventure purchased.
4. Duration of each adventure advertised by us is approximate. These duration times are given to us by the service provider as a guide. Any itinerary provided to you is indicative only and the order of the events may change.
5. Certain adventures provided by our service providers are subject to minimum age, health or other restrictions. It is your responsibility to check these restrictions with the service provider. Contact details of each service provider are given when a booking is confirmed.
6. Adventure photographs/descriptions are representative only. Images are either supplied by the service provider, purchased by ourselves, or are images that we own. The images used by Adventurous Women are protected by copyright and must not be copied in whole or in part without the written permission of Adventurous Women.
7. Adventurous Women is not liable for any inconvenience caused or expenses incurred by use of any information provided on our website. Adventurous women disclaims all liability for any errors, unauthorized access to your personal information or inaccuracies of information supplied by third parties. Adventurous Women will not be liable for direct, indirect, consequential or incidental damages, including but not limited to lost profits, savings or damages. The inclusion of a service provider on our website does not indicate that Adventurous Women endorses or recommends that service provider.
8. Independent service providers supply the information relative to their particular adventure, however we do try to ensure that our advertising information is accurate. The content or format of some of the adventures may change slightly from time to time, so we do recommend you check this with the service provider. Your participation in each adventure is subject to your acceptance of the service provider's Terms & Conditions. Adventurous Women makes no specific representation as to the standard, class or description of services provided by third parties including the service providers. Adventurous Women does not accept liability for any errors or omissions and reserves the right to change information published on our website. It is your responsibility to check our website from time to time for possible changes.
9. All the material on our website is subject to the copyright of Adventurous Women or its third party service providers. You must not reproduce any of the material contained on the website unless it is for your own personal use. You may not provide a link to our website from another website without Adventurous Women's written consent.
10. Cancellation by You - Adventurous Women and/or the service provider cannot refund or guarantee exchange should you fail to attend at an agreed date, time and place or if you fail to attend a re-scheduled date and time. If you are unable to attend an adventure on the confirmed date and time you selected you should immediately contact the service provider who will do their best to reschedule the adventure. Please note you may incur a cancellation fee from the service provider involved. Our service providers operate under their own cancellation policies which you will need to abide by.
11. Cancellation by the Service Provider - If a service provider needs to cancel a service for any reason, you will be notified as soon as possible to enable you to reschedule a convenient alternative date. Adventurous Women will not be liable for any travelling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.
12. Some of the adventures we promote as the agent, are considered dangerous. Prior to participating in any adventure you should be aware of the risks involved. Adventurous Women can provide further information if you are in any doubt about any adventure. It is a requirement that our service providers hold current Public Liability Insurance and provide us with a copy of it, before we will promote their services as the agent. Responsibility rests with you to make your own enquiries with the service provider and other third parties, as to the need to acquire your own insurance cover.
13. The Adventurous Women website may include links to other websites that are operated by third parties ("Third Party Websites"). Adventurous Women does not accept any responsibility for your use of the Third Party Websites and have not checked: (1) the accuracy or completeness of any information; or (2) the suitability or quality of the goods and services, made available on the Third Party Websites. Your use of the Third Party Websites may be subject to separate terms and conditions displayed on the Third Party Websites. You acknowledge that Adventurous Women may receive commissions in respect of goods or services that you purchase on a Third Party Website when you access that Third Party Website using a link from our Website. For instance, Travel Insurance is provided by 'Travel Insurance Direct', so when you click on the insurance banner you will be redirected to a website operated by Travel Insurance Direct. If you do not agree with any part of these terms and conditions, you must not use the Website. Adventurous women excludes all liability to you in relation to your use of the Website.
14. All Prices quoted are in Australian dollars, include GST and are correct at time of publication. Adventurous Women reserves the right to change prices without notice.
15. If you are the original purchaser of one of our adventures (whether or not you actually participate in the adventure purchased), it is your responsibility to inform all parties involved in the adventure, of these terms and conditions. The person making a booking acknowledges to have accepted these terms and conditions on behalf of everyone named in the booking.
16. By selecting the "Book Now" button or downloading any material or by accessing any data, information or material using the Website, you agree to be bound by these terms and conditions.
